US court broadens tariff refund eligibility in major trade ruling

The US Court of International Trade has expanded the scope of tariff refunds linked to previously invalidated measures introduced under the Trump administration.
In a new filing, the court amended an earlier order to include not only unliquidated and non-final entries, but also fully liquidated entries. The decision effectively broadens eligibility for importers seeking reimbursement.
The ruling follows last month’s Supreme Court decision striking down tariffs imposed under the International Emergency Economic Powers Act.
Under the updated directive, Customs and Border Protection is instructed to reliquidate affected entries without applying the invalidated tariffs.
Legal experts have described the move as a significant development, resolving uncertainty over whether finalised entries would qualify for refunds.
However, implementation will take time. The court has maintained a stay on the order to allow CBP to complete development of its refund system, known as the Consolidated Administration and Processing of Entries (CAPE).
According to the agency, the system is between 45% and 80% complete, with further updates expected.
